DNKNG Privacy Policy

This Privacy Policy explains how [DNKNG ENTITY]("DNKNG," "we," "us") collects, uses, and shares information when you use the DNKNG apps, website, and console (the "Service"). It is part of, and incorporated into, the Terms of Service.

The Service is in beta. Data practices may change as the product evolves, and we expect to reset data at official launch. See the Beta Technical Notice. The Service is intended for people 18 and older and is not directed to children.

1. Information we collect

Account & identity. When you sign in (for example, with Sign in with Apple), we receive an identifier and, depending on your choices, your name and an email or relay address. We do not receive your Apple password.

Profile. Display name, handle, avatar/portrait and shield imagery, home court(s), preferences, and similar details you add.

Gameplay & scoring. Matches, sessions, scores and point-by-point events, server/court position, lineups, results, timestamps, and corrections — including data you record on behalf of guests present at a court.

Ratings & statistics. Inputs to and outputs of our rating and stat systems, including peer assessments you give or receive and derived skill/stat profiles.

Gear & commerce signals. Paddles and gear you own or favorite, gear performance you generate by playing, and interactions with gear catalogs, store links, and recommendations (including clicks on affiliate links).

Courts, events & coordination. Courts, events, leagues, tournaments, seasons, and the messages and coordination-room activity you participate in.

Audio & transcripts. With your permission and when you enable the relevant features (voice/hands-free scoring, broadcast scoring, and development capture), we record audio from your device microphone and may generate transcripts. This audio can include the voices of other people near you. Captured audio and transcripts may be stored and used as described in §2.

Approximate location / court proximity. To suggest nearby courts and players and to show court-relevant weather, we may use a coarse or court-derived location. Weather is generally derived from the court, not from continuous tracking of your device. Where precise location is used, we ask your permission first.

Device & usage / diagnostics. App version, device and OS type, language, crash and performance diagnostics, feature usage, and similar telemetry used to operate and improve the Service.

We do notintentionally collect special-category data (such as health, precise biometric identifiers, or payment-card numbers). Please don't put sensitive personal information into free-text fields, messages, or images.

2. How we use information

We use the information to:

  • provide the Service — run matches and scoring, build profiles, compute ratings and statistics, power messaging/coordination, and sync across your devices (phone, watch, web console);
  • interpret audio and derive results — transcribe and parse voice/ambient audio to score matches, fill stat gaps, and improve accuracy;
  • improve the Service and our models — debug, analyze usage, and train and evaluate our automated and AI/ML systems (for example, scoring, ratings, enrichment, and image features);
  • build aggregated and de-identified insights — including statistics about gear performance, purchase patterns, and play patterns. We may publish or commercialize aggregated and de-identified data that does not identify you. This is central to how we expect to fund the Service (see the Beta Welcome);
  • communicate with you — service messages, beta updates, and support;
  • keep the Service safe — prevent abuse, enforce the Terms, and comply with law.

Legal bases (where GDPR/UK GDPR applies): performance of our contract with you (providing the Service); your consent (microphone/audio capture, precise location, and any marketing); and our legitimate interests in securing, analyzing, and improving the Service, balanced against your rights.

3. How information is shared

We do not sell your personal information. We share it only as follows:

  • Other users. By design, parts of your profile, ratings, statistics, gear, and match/coordination activity are visible to players you play, coordinate, or compete with, and to organizers of events you join.
  • Service providers (processors). Vendors who host and run the Service on our behalf — for example, cloud compute and database hosting, object storage for images and audio, AI/ML providers that process voice/text/images, app stores and identity providers, and weather/mapping providers. They may process data only to provide their service to us.
  • Aggregated / de-identified data, which does not identify you, with partners or the public.
  • Legal & safety. When required by law, to enforce our Terms, or to protect the rights, safety, and property of users, the public, or DNKNG.
  • Business transfer. In a merger, acquisition, or asset sale, subject to this Policy.

4. Audio, microphone, and others' privacy

Audio features only record when you grant microphone permission and enable them. Because captured audio may include other people, you are responsible for getting any consent the law in your location requires before recording. If you believe you were recorded without consent, contact us at [PRIVACY EMAIL] and we will work with you to address it, including deletion where appropriate.

5. Beta data practices, retention, and resets

  • We keep information for as long as needed to provide the Service and for the purposes above, then delete or de-identify it within a reasonable period — except where we must keep it longer for legal reasons.
  • Because this is a beta, your data may be wiped at any time, and we expect a full reset at official launch. The Service is not a backup service; keep your own copies of anything you need.
  • Aggregated and de-identified data, and data already used to train or evaluate models, may persist after your account is deleted.

6. Your choices and rights

  • Permissions. You control microphone and location access in your device settings; turning them off disables the related features.
  • Access, correction, deletion, portability. You may request a copy of your data, ask us to correct or delete it, or object to or restrict certain processing. You can delete your account in-app where available, or by contacting [PRIVACY EMAIL]; we will delete or de-identify your personal data except where retention is legally required or where data has already been aggregated/de-identified.
  • Region-specific rights.If you are in the EEA/UK, you have GDPR rights (including lodging a complaint with a supervisory authority). If you are a California resident, you have CCPA/CPRA rights (to know, delete, correct, and to opt out of "sale"/"sharing" — note we do not sell personal information). We do not discriminate against you for exercising these rights.

7. Security

We use reasonable technical and organizational measures to protect information. No system is perfectly secure, and the beta is not hardened to production standards — please do not store sensitive information in the Service.

8. International transfers

We may process and store information in the United States and other countries whose laws may differ from yours. Where required, we use appropriate safeguards for cross-border transfers.

9. Children

The Service is for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact [PRIVACY EMAIL] and we will delete it.

10. Third-party links

The Service links to third-party sites and stores (including affiliate links). Their privacy practices are their own; review their policies.

11. Changes to this Policy

We may update this Policy as the Service evolves. We will post the updated version with a new effective date and, for material changes, provide additional notice.
