DNKNG Terms of Service

1. Beta status — what you are agreeing to

1.1 The Service is provided as a beta / pre-release offering for testing and evaluation. Features are incomplete, experimental, and subject to change or removal at any time without notice.

1.2 Your data may be modified, corrupted, or deleted, and we expect to fully reset all accounts and data at or before official launch. We will make reasonable efforts to preserve or migrate data and to give notice, but we make no guarantee that any account, rating, statistic, match history, message, image, or other content will survive. Do not use the Service as your system of record. See the Beta Technical Notice.

1.3 We may limit, suspend, or end the beta — in whole or for any individual — at any time and for any reason.

2. Eligibility

2.1 You must be at least 18 years old to use the Service. By using it you represent that you are 18 or older and that you have the authority to enter into these Terms.

2.2 You must not use the Service if you are barred from doing so under the laws of your jurisdiction or any applicable sanctions or export-control rules.

3. The Service

3.1 DNKNG is a platform for playing, scoring, and analyzing pickleball and related activity — including hands-free and voice-assisted scoring, match and session management, ratings and statistics, player and gear profiles, courts and events, leagues, tournaments and seasons, messaging and coordination, and a web console for organizers and analysts.

3.2 Many features rely on automated and AI/ML systems (for example, voice and audio interpretation, score derivation, ratings, transcription, image generation, and stat enrichment). These systems can be wrong, incomplete, or delayed. You are responsible for reviewing and, where it matters, correcting their output. DNKNG is not a referee, officiating authority, or rating authority of record.

4. Your account

4.1 You sign in using a supported identity provider (for example, Sign in with Apple). You are responsible for maintaining the security of your device and your account and for all activity under it.

4.2 You agree to provide accurate information and to keep it current. You may not impersonate others or create an account for anyone who is not eligible.

4.3 Guest and captured players.The Service lets you record scores and activity for other people present at a court ("guests"), and lets a guest later claim an account that inherits that activity. If you enter, capture, or invite another person, you represent that you have their permission to do so and to process the resulting data as described in the Privacy Policy.

5. Acceptable use

You agree not to:

• break the law, infringe others' rights, or use the Service to harm anyone;
• harass, threaten, defame, or abuse other users, including in messaging and coordination rooms;
• upload content that is unlawful, hateful, sexually exploitative, or that you do not have the right to share;
• record or capture another person's voice, image, or activity without their permission where such permission is required by law;
• probe, scrape, overload, reverse-engineer, or interfere with the Service or its infrastructure, or circumvent any access or rate limits;
• misuse ratings, statistics, or scoring (for example, by manipulating results) to gain an unfair advantage or to mislead other players;
• use the Service to build a competing dataset or product, or to resell access.

We may remove content, restrict features, or suspend or terminate accounts that we reasonably believe violate these Terms, with or without notice.

6. Your content and the data you generate

6.1 You keep your rights.You retain ownership of the content you submit — profile details, images, messages, gameplay entries, and similar ("Your Content").

6.2 License to operate and improve the Service. You grant DNKNG a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting and processing), display, and transmit Your Content as needed to operate, secure, and provide the Service to you and the people you play and coordinate with.

6.3 License to analyze and improve. You also grant DNKNG a license to use the data generated through your use of the Service — including gameplay, scoring, ratings inputs, gear and purchase signals, play patterns, and audio/transcript captures — to operate, analyze, and improve the Service and its models and features, and to create aggregated and de-identified insights and statistics. We may use, publish, and commercialize aggregated and de-identified data that does not identify you. How this maps to our plans is described plainly in the Beta Welcome and governed by the Privacy Policy.

6.4 Audio and ambient capture. Some features record audio from your device microphone, which may include the voices of other people near you. You are responsible for obtaining any consent required by the laws of your location (some jurisdictions require all parties to consent to recording). See the Beta Technical Notice §6.

6.5 Other players can see some of your data. By design, parts of your profile, ratings, statistics, gear, and match history are visible to other players you play, coordinate, or compete with. Do not put anything in the Service you are not comfortable sharing in that context.

6.6 Feedback you send us about the Service is given freely, and we may use it without restriction or obligation to you.

7. Gear, store links, and third-party offerings

7.1 The Service may surface gear catalogs, recommendations, and links to third-party retailers, including affiliate linksfrom which DNKNG may earn a commission. DNKNG does not sell, ship, or fulfill third-party products and is not responsible for them. Purchases you make from a third party are governed by that third party's terms.

7.2 Weather, mapping, AI, and similar information is provided by third parties on an "as is" basis and may be inaccurate.

8. Payments, monetization, and donations

8.1 No charge during beta.We do not charge for access to the Service during the beta. We may introduce paid features, subscriptions, or seasonal/battlepass content in the future. If and when we do, we will disclose pricing and terms before you are charged, and any in-app purchases will go through the applicable app store's payment system as required.

8.2 Donations are voluntary and unlock nothing. We may offer an optional donation to help cover operating costs, available only on the website at [DONATE URL]. A donation is a voluntary gift to support development. It is not a purchase, it does not grant any feature, content, perk, rating, or advantage, and it is generally non-refundable. Donations are not tax deductible unless expressly stated. Do not donate if you expect anything in return beyond our gratitude.

9. Intellectual property

9.1 The Service, including its software, design, branding ("DNKNG," the wordmark, shields, and realm visual system), text, and graphics, is owned by DNKNG or its licensors and is protected by intellectual-property laws. Except for the rights expressly granted here, we reserve all rights.

9.2 We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose during the beta. You may not copy, modify, distribute, sell, or create derivative works from the Service except as the law permits without the ability to contract around it.

10. Third-party services

The Service runs on and integrates third-party providers (for example, app stores and identity providers such as Apple; cloud hosting, database, and storage providers; AI/ML providers; and weather and mapping providers). Your use may be subject to their terms, and we are not responsible for their acts or omissions. Apple and other app-store providers are not parties to these Terms and are not responsible for the Service.

11. Disclaimers

11.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. To the fullest extent permitted by law, DNKNG disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

11.2 We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or accurate, that defects will be corrected, or that data will be preserved. You acknowledge the beta nature of the Service and that data loss and resets are expected.

11.3 Scores, ratings, statistics, transcriptions, and AI outputs are provided for convenience and entertainment and may be inaccurate. Do not rely on them for any purpose where an error could cause harm or loss.

12. Limitation of liability

12.1 To the fullest extent permitted by law, DNKNG and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the Service — including any loss, corruption, or reset of data — even if advised of the possibility.

12.2 To the fullest extent permitted by law, DNKNG's total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amounts you paid DNKNG, if any, in the 12 months before the claim, or (b) USD $50. Because the beta is free, this amount will typically be USD $50.

12.3 Some jurisdictions do not allow certain limitations; in those places the above applies to the maximum extent permitted, and you may have additional rights.

13. Indemnification

You agree to indemnify and hold DNKNG harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right — including any claim that you recorded or captured another person without required consent.

14. Termination

14.1 You may stop using the Service and delete your account at any time (in-app where available, or by contacting [SUPPORT EMAIL]).

14.2 We may suspend or terminate your access at any time, including for violation of these Terms or to end the beta. Sections that by their nature should survive termination (including 6.2–6.3 as to data already processed, 9, 11, 12, 13, and 15) survive.

15. Governing law and disputes

15.1 These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-laws rules.

15.2 You and DNKNG agree to first try to resolve any dispute informally by contacting [SUPPORT EMAIL]. If that fails, the dispute will be resolved in the state or federal courts located in [STATE], and you consent to their jurisdiction — unless a separate, signed arbitration agreement applies. (If you want binding arbitration and a class-action waiver, insert that clause here on advice of counsel; it materially affects users' rights and must be conspicuous and enforceable in your jurisdiction.)

16. Changes to these Terms

We may update these Terms as the Service evolves. If we make material changes, we will provide reasonable notice (for example, in-app or by email). Changes take effect when posted with an updated effective date. Continuing to use the Service after that means you accept the updated Terms.

17. Miscellaneous

These Terms, with the Privacy Policy, are the entire agreement between you and DNKNG about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor.
